This User Agreement is effective upon acceptance for new users from 11th April, 2018 and may be amended from time to time with due notification.

PREAMBLE

This User Agreement comprises all the policies and services offered on AROWORA. You agree to comply with all of the terms of this User Agreement when using our services on the AROWORA platform.

The company you are contracting with is Trabar Trading Company Limited registered at House 53, 3^rd Avenue, FHA, Lugbe, FCT, Abuja but currently moved to BLK G2, Mercy Samuelson Estate, Karmo, FCT, Abuja.  Trabar Trading Company Limited is the owner of the website “www.arowora.com” which shall subsequently be referred to as “AROWORA” in the user agreement.

AROWORA is a website that allows users to offer, barter and donate any legal goods and services to other users. The contract of sale, barter and donation is between the seller and buyer or the giver and taker in the case of donations/free offers. AROWORA is not a traditional auctioneer neither does AROWORA have any current license as an auctioneer.

AROWORA has no control over items offered on its platform and cannot guaranty the authenticity, quality or legality of the goods and services offered on its platform;  the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

TRADING OR DONATING ON AROWORA

Users agree that they will not: 

1. Use our website if you are unable to form a legally binding contract under the laws of Nigeria as this will result in the suspension or deactivation of the users account;
2. Upload any inappropriate content including false, misleading, defamatory, libelous or any other content that will be in violation of the laws of Nigeria or state in which they reside on our website;
3. Pose as a reputable trader with the intention of defrauding and taking advantage of other traders e.g. uploading a fake product only to get the contact of others users.
4. Hesitate to pay for items won after a successful bid, unless you have a valid reason which must be disclosed to AROWORA via email not more than 24 hours after a bid. A trader who consistently makes false bids and deprive other traders will be blacklisted after suspension of their accounts.
5. Hesitate to deliver items put up for auction or barter, unless you have a valid reason which must be disclosed to AROWORA via email not more than 24 hours after a bid or deal. A trader who consistently refuses to deliver goods maybe suspended after trade credits have been exhausted or refunded
6. Manipulate or post false or in accurate ratings when such ratings are made available on AROWORA;
7. Clone any functionality or any information or software associated with AROWORA without prior permission of AROWORA;
8. Auction or barter the same goods they receive under the free offers on AROWORA. This will result in immediate disqualification on the platform.

DELIVERY

Delivery of goods under auction and barter will be the responsibility of the traders. The onus is on the seller to deliver the goods won by a successful bidder. The terms and cost of delivery will be discussed by both parties to the transaction. AROWORA does not perform delivery services but may do so at an appropriate time. However, the onus of delivery for free offers will be that of the taker.

We encourage delivery of goods and services to be in a public place or any place of trust by both parties. Traders must take due caution to prevent abuse from unscrupulous users.

Delivery of goods should be done without undue delay; any difficulties should be brought to the attention of AROWORA via its [email protected]

 

FEES

AROWORA takes a service charge for its services. The service charges are non-refundable, however in a case where the seller does not deliver the goods to the successful bidder under our auction service. The buyer shall be entitled to a full refund. This does not apply to the trade by barter and donation services.

A fee of 50 naira is charged to each trader under the trade and barter services when a deal is accepted. A token amount of 200 is charged on users who win the free donations uploaded by voluntary seller. However, the fee is refundable in trade credits if the giver does not make the goods available to the taker.

A commission of 10% of the final value is levied on all auctions (Please note that the 10% commission is inclusive of 5% sales tax).

Fees can be renewed from time to time, subject to notice to the users on AROWORA

A refund may be suspended if AROWORA suspects dishonesty/abuse in the dealing of traders who are parties to the refund.

 

LIMITATION OF LIABILITY

AROWORA will be monitored to ensure that users information are safe and that the functionalities are working optimally, but we cannot guarantee the continuous operation of AROWORA especially due to forces beyond our control.

You agree that you are making use AROWORA is at your own risk, and that they are being provided to you on an "AS IS" and "AS AVAILABLE" basis. Accordingly, to the extent permitted by applicable law, we exclude all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In addition, to the extent permitted by applicable law, we (including our parent, subsidiaries, and affiliates, and our and their officers, directors, agents and employees) are not liable, and you agree not to hold us responsible, for any damages or losses (including, but not limited to, loss of money, goodwill or reputation, profits, other intangible losses, or any special, indirect, or consequential damages) resulting directly or indirectly from:

1. Bugs, error or malfunction, or inaccuracies of any kind in AROWORA;
2. Delays or unavailability of services in AROWORA
3. The content you provide (directly or indirectly) using AROWORA;
4. Viruses or malware obtained by accessing AROWORA;

 

INDEMNITY

You will indemnify and hold TRABAR TRADING COMPANY LIMITED harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of this User Agreement, your improper use of AROWORA or your breach of any law or the rights of a third party.

FORCE MAJEURE

If either party is prevented from carrying out all or any of its obligations as stated in this contract for reasons beyond the control of that party including but not limited to Act of God, civil commotion, riots, insurrection, acts of government, fire or any other causes, the party so affected shall be relieved of its obligations as a result of such events and its consequences and shall not be liable to the other party.

 

AROWORA.COM Privacy Policy

This Privacy Policy applies to your use of this website and all arowora.com services (including payment services), goods, products and tools (referred to as "Services"), regardless of how you access or use these Services, including access via the website and app.

Arowora.com is responsible for the collection and processing of your personal data in connection with our Services and your use on our website and mobile applications.

  Arowora.com collects personally identifiable information (name, address, email address, phone number, financial data.) from you when you set up a free account and conduct transactions. While you can browse some sections of our site without being a registered member, certain activities such as selling goods or services, placing an order or taking a gift/free item(s), require registration.
